Keeping it in the family: grandparents’ right to access

Elizabeth HassallFamilies come in all shapes and sizes. Though parents are responsible for caring for their children and making sure their needs are met, grandparents often play an important part in ensuring children are brought up in a stable and nurturing environment.

While the significance of the grandparent’s role seems to be widely accepted, it is not one that has traditionally been defined in the context of English law. As a result, grandparents can often struggle to determine what, if any, rights of contact they have with their grandchildren in the event of a family break-up.

Julie waltonIn 2007 I lost contact with my granddaughter due to family breakdown.

Family breakdown can occur for a variety of reasons it could be because of separation/divorce, drug/alcohol issues, bereavement or family feud.

When it happened to me, I was devastated  and heartbroken. Becoming a grandparent was truly magical. I thought I would be able to be part of her life and watch her grow, it wasn’t to be.

The Taylor Wimpey study, based on interviews with 1,000 young people, found one in ten has turned to their grandparents for help to buy a home.

Charity warns of ‘care gap’ crisis as grandmothers providing childcare required to stay in work longer

Nearly two thirds (63%) of grandparents with grandchildren under 16 are providing childcare, (around 7 million in total), often to enable parents to work, with one in five (19%) of grandmothers providing at least 10 hours a week and half (50%) of mothers relying on grandparents to look after their babies when they return from maternity leave – according to new analysis from the charity Grandparents Plus.

Grandmother has won battle to be paid the same rate as a foster carer to look after her grandchild

Nigel PriestleyA grandmother who has battled for 6 years to be paid the same rate as a foster carer for looking after her granddaughter, has won her case in the Court of Appeal in London.

Kent County Council has convincingly lost a challenge in the Court of Appeal. In a judgement handed down on 10th November 2011, the three Appeal Court judges unanimously threw out a challenge by Kent against a decision made in 2010 in the High Court. The decision was that Kent had a duty to support a Grandparent caring for her granddaughter.

Grandparents can damage children during divorces

granparent and_childGrandparents can cause ''damage'' to children during divorces - by increasing levels of conflict between couples, it has been claimed.  

David Norgrove, a government adviser on family law, said some couples used their parents as ''weapons'' during bitter divorces. He said grandparents could be ''extremely important ina child's life'' but made problems worse by demanding the right to have contact with their grandchildren.

Grandparents typically contribute over £3,500 worth of support a year for childcare for grandchildren

A similar number regularly pay out to supplement their children's incomes and boost their grandchildren's living standards.
